On July 15, 2015, a judge in United States District Court Eastern District of Pennsylvania ruled that an exclusion which prevents strict liability claims to be brought in regards to prescription drugs should be extended to also exclude prescription medical devices. The plaintiff is bringing suit against Synthes USA Products claiming the company’s defective spinal implant was the cause of his broken back. Although the strict liability claims were denied, the plaintiff is still moving forward with claims over manufacturing defect, negligent design, negligence per-se, and failure-to-warn.

This settlement stands as good news for claimants in over 20 other cases spread throughout federal district courts across the country, in which similar claims are being brought.
