In 2008, Diane Miller was struck by a Duane Reade Pharmacy truck while crossing the road at 48th Street and 9th Avenue in New York City. The resulting injuries were severe, including a traumatic brain injury and blindness. Duane Reade attempted to counter claim that Miller slipped and fell on ice and ended up under the truck, but to no avail. The parties settled out of court for the reported amount of $22 million. This marks the largest settlement ever received for a personal injury claim in the state of New York.
